Held

The Court held that all the Excise Appeals are similar and identical to several other Excise Appeals that had been considered and decided by the Court in its judgment and order dated May 23, 2022, where CEA No. 10 of 2020 was the leading case. The Court found that no new grounds were available to the appellant, and therefore, the matter was squarely covered by the aforementioned prior decision. Consequently, the Court dismissed all the appeals on the same terms and conditions as laid down in the judgment and order dated May 23, 2022, passed in CEA No. 10 of 2020 and connected appeals. The ratio decidendi is that appeals presenting identical issues and no new grounds are bound by previous judicial pronouncements on those matters. No specific issues were left undecided; the appeals were disposed of based on precedent.

Facts

These are numerous Excise Appeals filed by the Commissioner of Central GST and Central Excise, J&K Jammu, against Kashmir Steel Rolling Mills. The appeals are stated to be similar and identical to several other Excise Appeals previously considered and decided by the Court. The Court notes that no new grounds are available to the appellant, and the matter is squarely covered by a prior decision dated May 23, 2022, in CEA No. 10 of 2020 and connected appeals. The specific tax periods, amounts in dispute, and the exact nature of the orders or actions under challenge are not detailed in this judgment, but it is understood that these appeals stem from prior proceedings before the authorities.

Key Issues

1. Whether the present Excise Appeals are covered by the Court's previous judgment dated May 23, 2022, in CEA No. 10 of 2020 and connected appeals, given that no new grounds are presented by the appellant? Petitioner/Appellant's Contention: The appellant, Commissioner of Central GST and Central Excise, J&K Jammu, implicitly argues that the appeals should be considered on their merits. However, the judgment explicitly states that no new grounds are available to the appellant, suggesting that their arguments, if any, do not introduce novel legal or factual aspects. Respondent's Contention: The respondent, Kashmir Steel Rolling Mills, would likely rely on the prior judgment of the Court, arguing that the present appeals are identical and should be disposed of in the same manner as the earlier cases. The judgment indicates that counsel for the parties were heard, implying the respondent presented their arguments, likely supporting dismissal based on precedent. Revenue/State's Contention: The judgment does not record specific arguments from the revenue or State beyond the implicit assertion that the appeals should be heard. The court's observation that no new grounds are available suggests the revenue's arguments did not persuade the court to deviate from the prior ruling.
