M/S Simnani Constructions vs. Union Territory Of J And K (Sales Tax) And Anr
Held
The Court held that the case of the present petitioner is indeed covered by the judgment passed in Sheikh Mohammad Yousuf’s case. The Court directed the petitioner to approach the Competent Authority for registration of their GST Number within seven days. The Competent Authority is to restore the petitioner's GST Number immediately upon completion of requisite formalities. The petitioner must then file returns and deposit taxes, along with penalty and interest, within seven days. The Court specified that if the petitioner fails to comply within the stipulated period, the order shall cease to be operational. The ratio decidendi is that if a case is factually and legally similar to a previously decided case by the same High Court, it should be disposed of in a similar manner, with directions for compliance by the petitioner.
Facts
The petitioner, M/s Simnani Constructions, filed a writ petition before the High Court of Jammu & Kashmir and Ladakh at Srinagar. The respondents were the Union Territory of J&K and another authority. The specific tax period and the amount in dispute are not recorded in the judgment. The procedural history indicates that the petitioner approached the High Court by way of a writ petition.
Key Issues
1. Whether the present case of the petitioner is covered by the judgment dated July 26, 2024, in WP (C) No. 1061/2024 titled ‘Sheikh Mohammad Yousuf v. Union Territory of J&K and Ors.’? Petitioner's contention: The petitioner argued that their case is entirely covered by the aforementioned judgment. Revenue/State's contention: The judgment records no specific argument from the respondents. However, the court's decision implies that the respondents did not contest the applicability of the prior judgment.
