Facts

The Petitioner, M/s MN Automobile Private Limited, filed a contempt petition against the Union of India and others for allegedly disobeying an order dated April 20, 2023, passed by the Delhi High Court. The original order directed the respondents not to pass a final order in a Show Cause Notice dated August 30, 2018, pending further hearings. The Petitioner contended that a final order was passed on January 17, 2025, in wilful disobedience of the Court's interim direction. The Respondents, represented by the Directorate General of GST Intelligence (DGGI), Adjudication Cell, tendered an unconditional apology, stating that the Petitioner's lack of cooperation in pending proceedings might have led to the interim order being overlooked. The Petitioner argued that the Department was aware of the stay order. The Court noted that while proceedings continued, the Petitioner had only appeared for personal hearing once.

Held

The Court held that the explanation provided by the Department regarding the passing of the final order dated January 17, 2025, did not appear to be lacking bonafides. Consequently, the unconditional apology tendered on behalf of the Department was accepted. However, the Court found that the order dated January 17, 2025, could not stand and was accordingly recalled and quashed. The Court directed the Department to deposit a sum of Rs. 10,000/- as costs with the Delhi High Court Bar Association within four weeks. The contempt petition was discharged subject to the fulfillment of this condition. The petition was disposed of in these terms.

Key Issues

1. Whether the Respondents wilfully disobeyed the order dated April 20, 2023, passed by this Court in W.P.(C) 5006/2023, thereby committing contempt of court? Petitioner's Arguments: The Petitioner argued that the Respondents, specifically the DGGI, deliberately passed a final order on January 17, 2025, in utter disregard of the Court's clear direction not to pass any final order until the next date of hearing. They contended that the Department was well aware of the stay order as it was passed after contest. Respondents' Arguments: The Respondents, through the DGGI, tendered an unconditional apology. They submitted that one part of the Court's order required the Petitioner to cooperate in the pending proceedings, which did not happen. Due to this lack of cooperation, the interim order might have gone unnoticed by the DGGI. They argued that their explanation for passing the final order lacked malafides.
