Facts

This matter concerns a miscellaneous application filed by the respondent-Department (Union of India, through Directorate of GST Intelligence - DGGI, Jaipur Zonal Unit) before the High Court of Rajasthan, Bench at Jaipur. The application sought to correct a clerical error in a previous order dated 16.09.2025. Specifically, the department pointed out that the term "Second Stay Application" was erroneously mentioned in Para 5 of the said order, whereas it should have been "Second Bail Application". The petitioner, Ankit Bansal, was present through his counsel and had no objection to the proposed correction. The application was filed to ensure the accuracy of the court's record.

Held

The Court allowed the miscellaneous application filed by the respondent-Department. It held that the clerical error in Para 5 of the order dated 16.09.2025, where "Second Stay Application" was mentioned instead of "Second Bail Application", was a bona fide mistake. In view of the petitioner's lack of objection and the nature of the error, the Court directed that the correction be made. The operative direction was that in Para 5 of the order dated 16.09.2025, "Second Bail Application" should be read and understood in place of "Second Stay Application". This corrected order was to be treated as a part of the original order dated 16.09.2025. The application was accordingly disposed of.

Key Issues

1. Whether a clerical error in a court order, specifically the misstatement of "Second Stay Application" instead of "Second Bail Application" in Para 5 of an order dated 16.09.2025, can be corrected by the Court upon application by the respondent-Department. Petitioner's Contention: The petitioner, through his counsel, had no objection to the correction sought by the respondent-Department. Respondent's Contention: The respondent-Department argued that a bona fide clerical error occurred in the previous order dated 16.09.2025, where "Second Stay Application" was mistakenly recorded instead of "Second Bail Application", and sought its correction for the proper record.
