Original PDF →Facts
The petitioners, Bhujadhari Trexim Private Limited & Ors., filed a writ petition challenging an impugned summons dated December 18, 2023, and search and seizure proceedings initiated by the Senior Intelligence Officer, Directorate General of Goods and Services Tax Intelligence (DGGI), Kolkata Zonal Unit. The summons required the petitioner's personal appearance on December 26, 2023. The petitioners sought to challenge these actions before the High Court.
Held
The Court was not inclined at this stage to interfere with the investigation arising out of the search and seizure proceedings. Regarding the impugned summons dated December 18, 2023, for personal appearance on December 26, 2023, the Court held that it had no more force and no cause of action survived. Consequently, the writ petition was dismissed. However, the Court clarified that no coercive action would be taken against the petitioner in the future except by observing due process of law, as the petitioner expressed a desire to participate and cooperate. The Court also noted that if the petitioner failed to cooperate, the respondent would be free to take coercive action.
Key Issues
1. Whether the High Court should interfere with ongoing investigations arising from search and seizure proceedings at this stage. The petitioners sought to challenge the summons and the search and seizure actions. The revenue, represented by the DGGI, contended that the court should not interfere with the investigation. The court considered the stage of the proceedings and the nature of the challenge. The issue of the validity of the summons was also implicitly before the court, particularly concerning its enforceability after the scheduled appearance date.
