Facts

Satyendra Kumar Construction Pvt. Ltd. (the petitioner) filed a writ petition challenging the disqualification of its technical bid for a tender (NIT No. 02/2024-25) issued by the Minor Water Resources Department, Government of Bihar. Initially, the petitioner's bid was found responsive on February 24, 2025. However, following a complaint regarding alleged suppression of litigation history and submission of forged papers for a mixture machine, a re-evaluation was conducted. A committee found the complaint fit to be allowed, citing the petitioner's submission of false and fabricated papers, including GST details of the machine's seller being closed since 2019-2020. This led to the petitioner's disqualification on June 13, 2025. The petitioner sought quashing of the disqualification decision and consideration of their representation.

Held

The Court did not decide the merits of the disqualification. Instead, it permitted the petitioner to file a representation before Respondent No. 2 (The Engineer In-Chief, Minor Water Resources Department) along with all relevant documents, including Annexures P/6, P/7, and P/8. Respondent No. 2 was directed to consider and dispose of this representation by passing a reasoned and speaking order, after affording an opportunity of hearing to both the petitioner and Lal Bhai Construction Equipment Private Limited, the supplier of the equipment. The Court explicitly stated that it had not expressed any opinion on the merits of the controversy, leaving all issues open for the competent authority to consider. The writ petition was disposed of with these directions.

Key Issues

1. Whether the petitioner's technical bid was wrongly disqualified based on allegations of submitting forged papers and suppressed litigation history, particularly concerning the GST status of the mixture machine supplier? (Question of mixed law and fact). Petitioner's Arguments: The petitioner contended that their technical bid was disqualified on "non-est grounds" and that coercive actions were contemplated without an opportunity to object. They sought consideration of their detailed representation dated June 16, 2025, and restraint on the finalization of the tender. Revenue/State's Arguments: The respondents stated that an initial complaint led to a review. A subsequent evaluation, prompted by findings in a related tender (NIT no. 01/2024-25), revealed that the petitioner had furnished false and fabricated papers for the mixer machine, including incorrect GST information for the seller. This led to the disqualification, citing Clause 30 of the NIT which requires bidders to certify the authenticity of all documents and makes them liable for false information.

That the Committee found that the bid submitted by the petitioner was responsive in its meeting held on 24.02.2025 and consequential order was communicated vide Memo no. 653, 654, 655 dated 25.02.2025 and Memo no. 690 dated 26.02.2025. Bidders were given opportunity to file objection against the above decision of the committee.

Thereafter complain/objection was submitted one Sri Monu Kumar regarding suppression of the Litigation History and submission of forged paper of mixture machine by the petitioner.

11.

That the committee headed by the Engineer in Chief, Minor Irrigation Department, Bihar, Patna looked into the complaint and found the 3/6 allegation made in the petition is not worth disqualifying the petitioner in the Technical Bid This meeting was held on 07.05.2025. 12. That in the meantime during the evaluation of the Technical Bid under Nawada Division (NIT no. 01/2024-25, Group no. 04), it has been found by the Departmental Tender Committee in its meeting held on 09.06.2025 that the complaint filed against the petitioner is fit to be allowed as he has furnished/uploaded false and fabricated paper of Mixer Machine and he has been declared disqualified in the Technical Bid. The GST of the Seller of Mixture Machine has been found closed since 2019-2020. The Committee further took decision to proceed against the petitioner in the light of Contractor Registration Rule for furnishing false and fabricated paper for obtaining Tender.
