HON'BLIi SMT. JUSTICE LALITHA KA\NEGANTI CRIMINAL PFI,TITION No.6712 0F 202r OIIDER: This petition is filed seeking to set aside the bail order, dated 18.11.2020, passed by the Special Judge for Economic Offences, Hyderabad.
The Special Judge for Economic Offices, Hyderabad, while granting bail to the respondent/accused, in Crl.M.P.No.237 ol 2020 (Comp.No.)/Crl.M.P.No.l794 of 2020 (Reg.No.) in F.No.INV/DGGVHZU/GST 1C310512020-21, dated 1 8. 1 1.2020, imposed the lollowing cond itions: (i) The petitioner/accused shall execute a personal bond for Rs.2,00,000/- (Rupees Two lakhs only) with two sureties -for the like sum each to the satisfaction of this Court. (ii) The petitioner/accused after release from iail shall appear before the respondent/complainant agency once in a week i.e., on every Monday betw'een 10.00 A.M. and 5.00 P.M. untilfurther orders. (iii) The petitioner/accused shall not leave the Coltntry) without prior permission of this Court and that he shall not threaten or tamper the evidence and shall co- operate with the Investigating Agency in completion of investigation in fair manner, as and when required'
Heard Sri B.Narasimha Sarma, learned Standing Counsel' appearing for the petitioner, and Mr.Ravi Kiran Singh, leamed counsel for the respondent/accused and perused the material on record' 4.Learnedcounselforthepetitionersubmitsasperthepanchanama' dated22.01 .2020, GSTR returns of M/s.cTIL Ltd. and invoices raised
2 by them to M/s.Avexa have been seized' As such, the invoices' purchase orders and agreements ledgers and other records have not been submitted for the security of the depafiment' Therefore, the submission of accused that the documents pertaining to the said case have been recovered is not at all true. Though the accused had not appeared on some days, he has signed in the gate register and left without appearing orinformingtheinvestigatingteam'Learnedcounselfurthersubmits that accused has failed to appear before the Court below on certain occasions in the other cases' Hence, he prayed to set aside the bail order, dated 18. 1 1'2020. 5.ontheotherhand,learnedcounselfortheaccusedsubmitsthat the accused is appearing before the Court below and has been complying with all the conditions imposed by the Court below' while granting bail'
