Heard Sri Zafar Ahmad Khan, learned counsel holding brief of Sri Abhinay Bhattacharya, learned counsel for the applicant, Sri Ramesh Singh, learned A.G.A. for the State and perused the record.

The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No. 0203 of 2023, under Sections-420, 467, 468, 471, 120-B IPC, Police Station- Sector 20 Noida, District-(Commissionerate) Gautam Buddh Nagar, during the pendency of the trial.

Contention of learned counsel for the applicant is that though the FIR was lodged against the unknown persons with the allegation that someone after misusing the GST number of the first informant formed a firm to misuse the same. Thereafter, during investigation this fact came into the light that about 2600 firms were formed on the basis of forged GST number just to defraud the State. Learned counsel for the applicant has produced the judgement dated 31.08.2024 of a Coordinate Bench of this court in leading Bail Application No.53010 of 2023 along with the connected bail applications of the co-accused persons, wherein the bail applications of the co-accused persons having similar role as of the applicant was rejected on the ground that such type of crime affects the economy of country and shall be dealt with strictly.

Learned AGA has also submitted that accused as well as other co-accused persons have been involved in serious fraud, therefore, he is not entitled to be enlarged on bail.

Considering the fact that the accused is involved in economic crime by committing serious fraud which has resulted to defraud

the State from GST and to get illegal benefit of Input Tax Credit and the bail application of the other co-accused persons have been rejected by a coordinate of this court, therefore, applicant is not entitled to be released on bail.
