For Petitioner: Suyash Agarwal
AI SummaryRemanded

Held

The Court held that the authorities failed to verify tax deposits by the seller and did not consider that the seller had filed GSTR-1 and GSTR-3B returns. The impugned orders were therefore unsustainable.

Facts

The petitioner, M/s Rama Brick Field, opted for GST composition scheme. Proceedings were initiated under Section 74 for purchases from Rohit Coal Traders, who was later found to be non-existent. The petitioner argued that since they did not avail input tax credit and the seller had filed returns, the action was unjustified.

Key Issues

Whether proceedings under Section 74 are justified against a composition dealer for purchases from a supplier who later ceased to exist, when the dealer did not avail input tax credit and the supplier had filed returns.
