The present anticipatory bail application has been filed on behalf of the applicant in case No. 474 of 2021 u/s 70 of the CGST Act, 2017 r/w section 174 & 175 of IPC u/s 132 (1)(b) CGST Act, 2017 & 132(1) (i) CGST Act, 2017, office of the principle Commissioner, CGST DGGI Meerut Zonal Unit, with a prayer to enlarge him on anticipatory bail, during trial.
The instant anticipatory bail application is pending since the year 2023, therefore, it reflects, either applicant has lost the interest in the matter or by efflux of time, the instant anticipatory bail application has become infructuous.
In view of the above, the instant anticipatory bail application stands dismissed.
However, it is open for the applicant to file recall application if cause of action still survives.
