AI SummaryRemanded

Facts

The petitioners approached the High Court challenging orders issued under Section 73 of the CGST Act. They argued that the orders were passed without proper examination of their accounts, particularly regarding the reversal of input tax credit.

Held

The Court set aside the impugned orders and remanded the matters back to the assessing authority for fresh consideration. The assessing authority was directed to provide adequate opportunity of hearing to the petitioners and pass fresh orders within six weeks.

Key Issues

The primary issues were the lack of an appellate authority and the non-examination of the petitioners' books of accounts by the assessing authority.
