issued by the second respondent herein under Section 168 A of the GGST Act,

of Article 14 and 21 of the constitution of lndia, illegal and declaring the second
proviso to section 162 of the CGST Act, 2017 as arbitrary, unreasonable and
amounts to excessive delegated legislation, contrary to the scheme of the CGST
Act, 2017 and violative of the Fundamental Rights guaranteeid under the
Constitution of lndia and set aside the said Notifications and G.O. as ultra vires
and consequently set aside the impugned oRDER-lN-ORIGINAL No. 100/2023-

3.The principal attack in this petition is to the Notification Nos.9 of 2023, dated 3t.O3.2O23 and 56 of 2023, dated 28.12.2023. The constitutionality/validity of tl:ese notifications was not disturbed by this court in a common order passed in W.P.No.1t54 of 2O24 and batch, dated O2.OL.2O2S. Thus, no challenge now remains to the notilications. The petitioner has an alternative remedy. As herd in the common Order passed in W.P.No.l154 of 2024 and, barch, if the petitioner prefers any appeal within forty five days from today, the appellate authority shall consider and decide his appeal on merits and it shall not be dismissed on the ground of limitation.
