Manmohan Harlalka vs. Addl Assistant Director, Dig Of GST Intelligence And Ors
Held
The Court noted that the impugned summon, issued on June 27, 2022, directing the petitioner to appear on July 4, 2022, had lost its force and no longer survived. Consequently, the Court was not inclined to interfere with the summon. However, the Court directed that if the authority found it necessary to issue any fresh summon against the petitioner in the future, sufficient time would be granted for compliance. The Court did not decide on the merits of the summon itself, only its current enforceability. The ratio of the decision is that a writ petition challenging a summon that has expired will be dismissed, but with a direction for future compliance.
