Held

The Court held that the respondents had complied with its previous orders by making the approved final bill amount payment. The statutory deductions made by way of SGST and CGST were acknowledged, and the remaining amount was paid to the petitioner. The Court's reasoning was based on the confirmation from both parties that the payment, after deductions, had been made. The ratio of this decision is that a contempt case can be closed as complied with if the primary financial obligation ordered by the Court is met, even if there are subsequent disputes regarding deductions, provided the aggrieved party is granted liberty to challenge those deductions separately. The operative direction was to close the Contempt Case as complied with, granting the petitioner liberty to challenge the statutory deductions made by the respondents.

Facts

The petitioner filed a Contempt Case No. 1505 of 2022 before the High Court. The petitioner's counsel submitted that the entire amount claimed by the petitioner had been received, except for statutory deductions. The respondents' counsel confirmed this, stating that statutory deductions for SGST and CGST were made, and the remaining amount was paid. The Court noted that once the respondents complied with the Court's orders by making the approved final bill payment, the Contempt Case would be closed. The petitioner was granted liberty to challenge the statutory deductions if they were not liable for them.

Key Issues

1. Whether the respondents have complied with the orders of the Hon'ble Court by making the approved final bill amount payment, considering the statutory deductions made for SGST and CGST. Petitioner's Contention: The petitioner's counsel submitted that the entire amount claimed was received, except for statutory deductions, implying a potential dispute over these deductions. The petitioner sought compliance with the Court's prior order. Revenue/State's Contention: The respondents' counsel confirmed that the approved final bill amount was paid, with statutory deductions for SGST and CGST being made. They asserted compliance with the Court's order by releasing the net amount.
