O R D E R This Writ Petition is filed seeking the following relief:
“….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not releasing the amount of Rs.7,67,653/- (Rupees Seven Lakhs Sixty Seven Thousand Six Hundred Fifty Three only) to the petitioner even after the timely execution of „Providing BT Renewals to the road from Pedaballi- Settipalli road to Buggapalli (V) of Puttaparthy Mandal” vide Agreement No.6/2020-21 dated 23.03.2021, as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently, direct the respondents to forthwith pay Rs.7,67,653/- (Rupees Seven Lakhs Sixty Seven Thousand Six Hundred Fifty Three only) to the petitioner along with 12% interest per annum and pass such other order or orders…”
Heard learned counsel for the Writ Petitioner, learned Assistant Government Pleader for Panchayat Raj and Rural Development representing respondent Nos.1 and 4, learned Assistant Government Pleader for Finance, representing respondent Nos.2 and 5 and learned Assistant Government Pleader for Revenue, representing respondent No.3. 3. The Writ Petitioner claims to be a Class-I Contractor in construction business and undertook multiple construction works, including works entrusted by the Government of Andhra Pradesh in and around Sri Satya Sai and Ananthapuram Districts. The Writ Petitioner was given contract work of providing BT renewals to the road from Pedaballi-Settipalli road to Buggapalli (V) of Puttaparthy Mandal and pursuant to the same, the respondent No.4 and the Writ Petitioner entered into an Agreement vide No.6/2020-21, dated 23.03.2021. The Writ Petitioner executed the entire work as per the Agreement, and the respondent authorities examined and scrutinized the same and made entries in the M-Book. The respondent authorities also completed Quality Control Inspection. Though the Writ Petitioner approached the respondent authorities on multiple occasions, requesting for payment of bills for an amount of Rs.7,67,653/-, they are not doing so. According to Writ Petitioner, having executed the work satisfactorily, within the prescribed time, non-payment of the bill amount was arbitrary and unjustified. It was further contended that the delay in payment is causing severe financial hardship, necessitating the filing of the present Writ Petition seeking appropriate directions for release of the outstanding amount.
Learned Assistant Government Pleader for Panchayat Raj and Rural Development, on written instructions received from the Executive Engineer, PR PIU Division, Puttaparthi, Sri Sathya Sai District-4th respondent, submits that the Writ Petitioner is entitled to an amount of Rs.7,67,053/- after statutory deductions such as Seigniorage charges, SGST and CGST etc., aggregating to Rs.79,130/-. She further submits that the Final Bill for the contract work was scrutinized and prepared in the office of 4th respondent, and the bill would be submitted in the Nidhi Portal to the office of 5th respondent after budget allocation. The written instructions are placed on record.
Having regard to the fact that, there is no dispute with regard to the works executed by the Writ Petitioner and the amount payable to him, and in view of the submissions of the learned Assistant Government Pleader for Panchayat Raj and Rural Development, the respondent authorities are directed to pay the entitled amount of Rs.7,67,053/- (Rupees Seven Lakhs Sixty Seven Thousand and Fifty Three only) to the Writ Petitioner within a period of Six (6) weeks from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs of the Writ Petition. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition, shall stand closed.
