Held

The Court held that the petitioner's request for a personal hearing was not granted, which was crucial given the factual dispute. Subsequent events indicated a clarification that even dried tamarind might be excluded from GST.

Facts

The petitioner was levied GST at 5% on tamarind fruit, which they claimed was exempted. The authorities classified it as 'dried tamarind' and made it taxable, issuing an order without a personal hearing. The petitioner argued that 'tamarind' in common parlance is exempted and there's no clear definition of 'dried tamarind'.

Key Issues

Whether tamarind fruit is taxable under GST, and if 'dried tamarind' is a distinct taxable category. The denial of a personal hearing to the petitioner was also a key issue.
