Rk Infracorp Private Limited vs. Assistant Commissioner Of State Tax
Held
The Court held that the impugned endorsement rejecting the refund had no statutory basis and effectively reviewed the earlier order without proper procedure. The Court also noted a contradiction in the initial order, which sanctioned the refund while also stating it was rejected.
Facts
The petitioner sought a refund of excess credit in their Electronic Cash Ledger, which was initially sanctioned by an order dated 19.03.2020. However, a subsequent endorsement dated 28.05.2022 rejected the refund request, citing non-submission of documents and lack of personal hearing.
Key Issues
Whether the endorsement rejecting the refund was legally sustainable, and if the initial order sanctioning the refund was erroneous and could be reviewed by a subsequent endorsement.
