Held

The Court held that there was no justification for the respondents to withhold the Earnest Money Deposit, Withheld Amount, FSD, and GST amounts from the petitioner, especially after the completion of the defect liability period. The Court found the respondents' action to be inappropriate given the circumstances and the submissions made by both parties. The ratio decidendi is that statutory or contractual dues, once no longer exigible or when the conditions for their retention are no longer met, must be released promptly. The Court directed the respondents to release the Earnest Money Deposit, Withheld Amount, FSD, and GST amounts due to the petitioner within four weeks from the date of receipt of a copy of the order. No issue was expressly left undecided.

Facts

The petitioner, a contractor, filed a writ petition challenging the respondents' action in withholding Earnest Money Deposit (EMD), Withheld Amount, FSD, and GST amounts related to works executed in Krishna District. The petitioner contended that the works were completed as per agreements, measured and paid for, and the defect liability period had expired. Despite multiple requests, the respondents failed to release these amounts. The respondents, through the Government Pleader, stated their readiness to pay the due amounts.

Key Issues

1. Whether the respondents are justified in withholding the Earnest Money Deposit, Withheld Amount, FSD, and GST amounts from the petitioner after the completion of the defect liability period, contrary to the terms of the agreements. Petitioner's contention: The petitioner argued that since the works were completed, measured without defects, and the defect liability period had expired, the withholding of EMD, Withheld Amount, FSD, and GST amounts was unjustified and contrary to the contractual obligations. They sought the release of these withheld sums. Revenue/State's contention: The learned Government Pleader submitted that the respondents were ready to pay the amounts due to the petitioner.
