N. Ravindra Reddy vs. The State Of Andhra Pradesh
Held
The Court acknowledged that the principal amount claimed by the petitioner had been paid by the respondent authorities. Regarding the claim for interest on delayed payment, the Court found the submission of the learned Government Pleader to be valid and sustainable. The Court held that the petitioner was at liberty to pursue their claim for the differential amount or interest amount, if any, by initiating fresh/separate legal proceedings in accordance with law. Consequently, the writ petition was rendered infructuous. No costs were awarded.
Facts
The petitioner filed a writ petition before the High Court challenging an action by the respondent authorities. The dispute involved a claim by the petitioner for a certain amount. During the hearing, the Government Pleader for Finance and Planning submitted that the respondent authorities had paid the total due amount claimed by the petitioner. However, the petitioner's counsel contended that while the principal amount was paid, the interest claimed by the petitioner for delayed payment was not. The Court noted that the principal amount had been paid and that the claim for interest could be pursued through separate legal proceedings.
Key Issues
1. Whether the respondent authorities have paid the full amount claimed by the petitioner, including interest, as per the petitioner's contention, or only the principal amount as admitted by the petitioner's counsel. Petitioner's contention: The respondent authorities have failed to pay the interest amount claimed by the petitioner, despite paying the principal amount. Revenue's contention: The respondent authorities have paid the total due amount claimed by the petitioner. The revenue also contended that any further claim for interest for delayed payment can be agitated by way of separate legal proceedings.
