Deveneni Ratna Bhushanam vs. The State Of Andhra Pradesh
Held
The Court acknowledged the submission by the learned Government Pleader that the principal amount claimed by the petitioner had been paid. The Court also found merit in the Government Pleader's contention that any further claim for interest due to delayed payment could be pursued by the petitioner through separate legal proceedings. Consequently, the Court held that the Writ Petition had become infructuous. The Court granted liberty to the petitioner to initiate fresh/separate legal proceedings to claim any differential or withheld amount, including interest, in accordance with the law. No costs were awarded.
Facts
This matter concerns Writ Petition No. 8693 of 2022 filed before the Indian High Court. The petitioner sought certain dues from the respondent authorities. During the hearing, the learned Government Pleader for Finance and Planning submitted that the respondent authorities had paid the total due amount claimed by the petitioner. However, the learned counsel for the petitioner contended that while the principal amount was paid, the interest claimed by the petitioner had not been paid. The Court noted that the principal amount had been paid and that the petitioner's further claim for interest could be pursued through separate legal proceedings.
Key Issues
1. Whether the respondent authorities have paid the full amount claimed by the petitioner, including interest, as per the petitioner's contention? (Mixed question of law and fact, turning on the interpretation of 'total due amount' and the specific claims made by the petitioner). Petitioner's contention: The respondent authorities have paid only the principal amount and have failed to pay the interest claimed by the petitioner. Revenue/State's contention: The respondent authorities have paid the total due amount claimed by the petitioner.
