Brief facts of the case are that the petitioners are working as Junior Assistants, Drivers, Gardeners, Cooks, Attenders, Carpenters 86 Electricians etc. in Dravidian University and they joined during the period 2004-2011 through the selection process done by the University, since they were qualified for the respective posts as per their educational qualifications. It is further stated that all this exercise has been done pursuant to the Notifications and they were directly appointed by the University and they were paid consolidated salary by the University.
While the matter being so, the 3^^ respondent University engaged outsourcing agency in the year 2006 i.e. M/s.Ghousia Voluntary Society, Chittoor and the petitioners were paid salary through the said agency. Till March 2022, the salaries were paid in terms of G.O.Ms.No. 151, dated 08.08.2016 and subsequently, the Government of Andhra Pradesh issued G.O.Ms.No.7, dated 17.01.2022 by fixing the remuneration for outsourcing manpower under various categories. Upon which, the respondent issued e-Procurement Tender Notice DU/EST/Tender NIT No.03/DU/Engg/23-2 4, dt 19.10.2023 inviting tenders from registered firms for supply of power for providing various kinds of personal to the University outsourcing basis, with a view to replace the petitioners. Respondent No.3-Dravidian University filed additional counter duly stating that as the existing agency under which the petitioners are engaged does not possess required documents such as EPF Registration, ESI Registration, GST Registration and Government permission to engage outsourcing employees. Hence, the respondent University has issued fresh e-Procurement Tender Notice vide NIT No.03/DU/Estt/23-24, dated 19.10.2023 and the respondent is entering into contract with a new outsourcing agency only with an intention to replace the existing 254 functionaries with new outsourcing agency in view of the e-Procurement tender notification dated 19.10.2023. 6. As per the said counter affidavit it is clear that as the agency under which the petitioners have been engaged does not possess requisite documents and without there being proper documents and permission from the Government, the salary bills of the employees cannot be processed through online website. It is further made clear that the respondent issued fresh e-Procurement tender notification dated 19.10.2023 calling for a new agency, but it is not the case of the respondents that they have intend to discontinue or replace the petitioners herein. It is specifically stated by the 3‘'d respondent in the additional counter filed that they wanted to continue the existing 254 functionaries with the new outsourcing agency with whom the 3‘d respondent is intending to enter into contract in view of the e-Procurement tender notification dated 19.10.2023. Since it is not the case of the 3'‘d respondent that they want to discontinue or replace the petitioners herein, the petitioners may not be aggrieved under e- Procurement tender notification dated 19.10.2023. Taking into consideration the statement made by the 3rd respondent in the additional counter affidavit, this Court feels it appropriate to dispose of the Writ Petition by directing the 3rd respondent to continue the petitioners under the new outsourcing agency but, however with the terms & conditions, under which they have been engaged earlier. The petitioners are at liberty to raise their grievances, if any, in future, for enhancement of the salaries in view of the subsequent G.O.s. 7. same
