Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be
pleased topleased to issue order or orders, direction or directions, Writ or
Writs particularly one in the nature Writ of Mandamous or any appropriate writ
declare the action of the respondents in not paying the bills for execution of
works vide (1) Agreement No. 90/2020-21 Dt.23-03-2021, (2) Agreement No.
89/2020-21 Dt.17-02- 2021 and (3) Agreement No. 91/2020-21 Dt.25-03-2021
awarded by 6th respondent a n d worth of Rs.15,39,392/- to the petitioner
with 12percent GST and interest till to day from the date of completion of
respective works as illegal, arbitrary violation of principles of natural justice
and violative of Article 14, 16, 21 of the Constitution of India, consequently
direct the respondents to release the bills for the above complited works
immediately with 12percent GST and interest and to and to pass

Petition under Section 151 CPC praying that in the circumstances stated
in the affidavit filed in support of the petition, the High Court may be pleased
pleased to direct the respondents to release the amount of Rs.15,39,392/-
towards payment of above final bills for the contract works under taken by the
petitioner long back, pending disposal of main WP No. of 2022 and to pass

ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue order or orders, direction or directions, Writ or Writs particularly one in the nature Writ of Mandamous or any appropriate writ declare the action of the respondents in not paying the bills for execution of works vide (1) Agreement No.90/2020-21 Dt.23.03.2021, (2)Agreement No.89/2020-21 Dt.17.02.2021 and (3) Agreement No.91/2020-21 Dt 25.03.2021 awarded by 6th respondent and worth of Rs.15,39,392/- to the petitioner with 12% GST and interest till today from the date of completion of respective works as illegal, arbitrary violation of principles of natural justice and violative of Article 14, 16, 21 of the Constitution of India consequently direct the respondents to release the bills for the above completed works immediately with 12% GST and interest and to and to pass such other order or orders…”
2.Heard learned counsel for the petitioner and the learned counsel appearing for the respondents.
3.At the time of hearing, Ms.K.Indu, learned counsel representing Sri K.L.N.Swamy, learned counsel for the petitioner stated that, pending the writ petition, the respondents have paid the amounts due to the petitioner. Therefore, requested this Court to close the writ petition.
4.Recording the above submission made by the learned counsel for the petitioner, the Writ Petition is closed. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, in this Writ Petition, shall stand closed.
