Prasanta Kumar Pattnaik vs. Finance
Held
The Court acknowledged the issue faced by contractors due to the transition to GST for works contracts. The Revenue submitted revised guidelines dated December 10, 2018, which provide a comprehensive procedure for determining the GST-inclusive work value for the balance work executed after June 30, 2017, for contracts tendered before July 1, 2017. These guidelines outline steps for ascertaining the balance work value, applying revised rates, adjusting for tender premium/discount, and adding the applicable GST. Crucially, the guidelines stipulate that if the revised GST-inclusive work value for the balance work exceeds the original agreement work value, the contractor is to be reimbursed for the excess amount. Conversely, if it is less, the payment is to be reduced, and any excess payment already made is to be recovered. The Court directed the petitioner to make a comprehensive representation before the appropriate authority, which would then consider and dispose of the representation in light of these revised guidelines. The Court also granted a period for the authority to decide and stated that the petitioner could challenge the decision if aggrieved. No coercive action was to be taken against the petitioner until March 31, 2019.
Facts
The petitioner, a contractor, challenged the action of the opposite parties (State authorities) in not reimbursing the differential tax amount arising from the transition from Value Added Tax (VAT) to Goods and Services Tax (GST) effective July 1, 2017. The petitioner also challenged Clause 6 of a Finance Department Memorandum dated July 22, 2017, and Clause 1(iii) of a subsequent Memorandum dated December 7, 2017. The core grievance was that the GST regime imposed taxes not originally envisaged when agreements were entered into. The State submitted revised guidelines dated December 10, 2018, superseding the earlier ones, which addressed the issue of works contracts under GST for tenders invited before July 1, 2017, but executed partly or wholly after that date.
Key Issues
1. Whether the petitioner is entitled to reimbursement of the differential tax amount arising from the change in tax regime from VAT to GST for works contracts entered into prior to July 1, 2017, but executed thereafter? 2. Whether Clause 6 of the Finance Department Memorandum dated July 22, 2017, and Clause 1(iii) of the Finance Department Memorandum dated December 7, 2017, are valid in so far as they do not adequately address the reimbursement of differential GST amounts for works contracts? Petitioner's Contention: The petitioner argued that the introduction of GST resulted in an increased tax burden that was not contemplated at the time of entering into agreements, necessitating reimbursement of the differential tax amount. The petitioner relied on the principle that contractual obligations should not be adversely affected by subsequent legislative changes without adequate provision for compensation. Revenue's Contention: The Revenue submitted that revised guidelines were issued on December 10, 2018, which provide a mechanism for determining and reimbursing the GST-inclusive work value for the balance work executed after the GST implementation. The Revenue indicated that these revised guidelines superseded the earlier ones and offered a solution to the petitioner's grievance.
