This interlocutory application is filed for modification order dated 13.03.2019 passed in W.P.(C) No.17282 of 2018. Learned counsel for the petitioner appended the schedule of modification as appended to the instant Interlocutory Application, which are quoted below.

“A. In page-8 paragraph 2.8 in the first line inadvertent wrongly word “high Court of Andhra Pradesh may kindly be deleted and replaced with the following:

“High Court of Kerala”

B. In the very first line of page-15 of the Order dated 13-03-2019 the inadvertent wrongly typed citation i.e., “[2018] 58 GSTR 53 (AAR)” may kindly be deleted and replaced with the following :

“2018 VIL 491 Bom.”

C. In third and fourth line of paragraph-2.12 at page- 16 of the Order dated 13-03-2019 the inadvertent wrongly typed citation i.e. “reported in [2008] 58 GSTR 53 (AAR)” may kindly be deleted and replaced with the following:-

“vide its Order dated 31st January, 2019 in Writ Petition No.3159/2019 (T-RES.)”

D. In third and fourth line of paragraph-3 at page-17 of the Order dated 13.03-2019 the inadvertent wrongly typed observation after the word “Accordingly,” i.e., “the impugned order is quashed and” may be deleted.”

Considering the above, we recall the order dated 13.03.2019 passed in 17282 of 2018 and fresh order is passed vide order of the day incorporating necessary corrections as sought for and quoted above.

Regarding remission of the matter to the authority is concerned, it is clarified that the Authority is ‘GST Council’. Accordingly, necessary correction may be made in the order dated 13.03.2019 wherever it appears in paragraph-3. Order dated 13.03.2019 is modified to the extent indicated above only. Rest part of the order dated 13.03.2019 remains unaltered.

Accordingly, the Interlocutory application is disposed of.

Issue urgent certified copy of the order on proper application.
