Held

The Court held that it was an obvious fact that if the petitioner had not earned anything from the plantation in 2019 due to the cyclonic storm 'FANI', it would be impossible for them to make the required deposit towards royalty and GST for the year 2020. The Court acknowledged that the petitioner's purpose would be served if the arbitration proceeding before Opposite Party No. 5 was completed within a reasonable time. Consequently, the Court disposed of the writ petition by directing Opposite Party No. 5 to complete the arbitration proceedings by the end of February 2020, after affording an opportunity of hearing to both parties. Until the disposal of the arbitration proceedings, no insistence was to be made on the petitioner for the deposit of royalty and GST for the year 2020. The ratio decidendi is that in cases of unforeseen natural calamities causing substantial loss, financial obligations may be deferred pending resolution of damage assessment and compensation.

Facts

The petitioner filed a writ petition seeking a direction to the Divisional Manager, Bhubaneswar (Commercial) Division, Odisha Forest Development Corporation, not to realize royalty (lease rent) and GST for cashew plantation plots auctioned for the year 2020. The petitioner's grievance stemmed from the damage caused by cyclonic storm 'FANI' in 2019, which resulted in a near 90% crop loss. The matter of assessing this damage had been referred to arbitration before Opposite Party No. 5. The petitioner argued that if no income was earned in 2019 due to the storm, it would be impossible to deposit the required royalty and GST for 2020. The petition sought to link the completion of arbitration with the deposit obligation.

Key Issues

1. Whether the petitioner should be compelled to deposit royalty and GST for the year 2020 for cashew plantation plots, given the significant crop loss in 2019 due to cyclonic storm 'FANI' and the ongoing arbitration proceedings to assess damages. Petitioner's Arguments: The petitioner contended that the crop loss in 2019 made it impossible to meet the deposit requirements for 2020. They argued that their purpose would be served if the arbitration proceedings, which also included a prayer for refund of royalty and GST paid for 2019, were completed within a reasonable timeframe. The petitioner relied on the principle that financial obligations should be considered in light of unforeseen events causing substantial losses. Revenue/State's Arguments: The judgment does not record any specific arguments made by the revenue or state authorities. The court's decision appears to be based on the facts presented by the petitioner and the circumstances of the case.
