Mohanty, learned counsel appearing for the petitioner has submitted at the outset that the petitioner-assessee has instructed not to proceed with this application inasmuch as the assessee has decided to pursue his remedy in the appellate forum. It is needless to refer that the assessee may raise all the objection, as raised in this writ petition, in the appeal.

Hence, this writ petition stands dismissed as withdrawn, subject to the observation as made above.
