Heard Mr. S.R. Mulia, learned counsel appearing for the petitioner.
The petitioner has filed this writ petition seeking to quash the order/letter dated 09.05.2023 under Annexure-8, by which opposite party no.3 has directed the petitioner to deposit a sum of Rs.10,75,956/- towards outstanding license fee and GST with interest as on 30.04.2023 within 7 (seven) days from the date of receipt of the letter, failing which the petitioner shall vacate the parking area within next 7 (seven) days.
Mr. S.R. Mulia, learned counsel appearing for the petitioner contended that since there was inaction on the part of the authority, as a consequence thereof the order impugned dated 09.05.2023 under Annexure-8 has been passed. Therefore, the petitioner has approached this Court by filing this writ petition.
As it appears, the order impugned dated 09.05.2023 under Annexure-8 emanates from the contract executed between the petitioner and the opposite party-authority. If any condition of the contract has not been complied with or is required to be complied with, the petitioner has to approach the appropriate forum or authority. Instead of doing so, the petitioner has approached this Court directly by filing this writ petition, to which this Court is not inclined to entertain. However, liberty is granted to the petitioner to pursue its remedy before the appropriate forum.
With the above observation, the writ petition stands disposed of.
