Heard.
The present writ petition has been filed with the following prayer:-
“In the facts and under the circumstances stated above, the Hon’ble Court would graciously be pleased to admit this WRIT application and issue; a) RULE NISI to show cause why the action of the opp. parties contravening government guidelines shall not be declared illegal, arbitrary and contemptuous; And if they fail to show cause or show insufficient cause make the Rule Absolute. b) A WRIT in the nature of Mandamus directing the O.P. No.4 to reimburse the approved GST amount along with simple interest in accordance with law; c) Issue any appropriate writ(s)/direction(s)/ order(s) deemed fit in the fact and circumstances of the case.”
In course of hearing, learned counsel for the Petitioner
states that highlighting his grievance, the Petitioner has made a representation to Opposite Party No.4 vide Annexure-4 series and the same may be directed to be considered within a stipulated time taking into account the supplementary agreements under Annexure-3 series, to which learned counsel for the State has no objection.
As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing Opposite Party No.4 to consider the representation filed by the petitioner vide Annexure-4 series, and pass appropriate order in accordance with law taking into account the supplementary agreements under Annexure-3 series, within a period of three months from the date of production of certified copy of this order.
Issue urgent certified copy as per Rules.
