Heard learned counsel for the parties.
The petitioner has filed this writ petition with the following prayer: “It is therefore prayed that this Hon’ble Court may graciously be pleased to consider the facts stated in the writ petition, admit the same, issue Rule NISI calling upon the Opp.Parties to show cause:-
i) Why the GST quoted by the petitioner as per the government guideline which is at the rate of 18%
on consolidated remuneration and service charges
shall not be accepted by the Opposite Parties.
ii) Why the petitioner shall not be issued with the work order by the Opp.Parties being the successful
L-1 bidder pursuant to the Tender Call Notice
No.588 ded.29.02.2024 invited by the O.P No.2-
Collector, Bolangir.”
In course of hearing, learned counsel appearing for the petitioner states that the petitioner has already made representation before Opposite Party No.3 vide Annexure-3, and the same may be directed to be disposed of taking into consideration Annexure-4 within a stipulated time, to which learned Counsel for the State has no objection.
As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing the authority to consider and dispose of the representation filed by the petitioner vide Annexure-3 and pass appropriate order taking into consideration Annexure-4 as early as possible within a period of three months from the date of production of certified copy of this order.
