Heard learned counsel for the parties.
The petitioner has filed this writ petition with the following prayer:
“In the circumstances stated above, it is therefore prayed that the Hon'ble Court may graciously be pleased to issue writ/writs, order/orders, direction/directions, under Articles 226 and 227 of the Constitution of India and more particularly to issue :-
(a) writ of mandamus directing the Opposite Parties to grant refund of Rs. 2,74,873.00 as per refund
application vide Annexure-3 together with the statutory interest provided under the Odisha Value
Added Tax Act, 2004 within a stipulated period of time;
(b) To pass such further order/ orders,
direction/directions, as may deem fit and proper, in favour of the petitioner.”
In course of hearing, learned counsel appearing for the petitioner states that the petitioner has already made representation before Opposite Party No.2 vide Annexures-3 and 5 Series, and the same may be directed to be disposed of within a stipulated time, to which learned Counsel for the Opposite Parties has no objection.
As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.2 to consider and dispose of the representation filed by the petitioner vide Annexures-3 and 5 Series and pass appropriate order as early as possible within a period of three months from the date of production of certified copy of this order.
