Heard learned counsel for the Petitioner and learned Addl. Government Advocate for the State. Perused the records.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail, involving offence punishable under Sections 420/294/506/34 of IPC in G.R. Case No.474 of 2024 of the Court of learned S.D.J.M., Malkanagiri arising out of Malkanagiri P.S. Case No.382 of 2024. 4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the present case. As per the F.I.R. allegation, he further contended that the informant had paid money to accused Manoj Sutar, who had taken money to arrange a govt. job in CT and GST Office of the State of Odisha. He further emphatically submitted that no money has been transferred to the .

Considering the seriousness of the allegation, gravity of the offence and the facts of the case, although I am not inclined to grant anticipatory bail to the Petitioner, however it is observed that, in the event the Petitioner surrenders and moves for bail before the learned court in seisin over the matter within a period of three weeks from today, he shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper. Violation of any of the above conditions shall entail cancellation of the bail application.

It is further directed that the bail granted to the petitioner is subject to verification of criminal antecedent. In the event, the Petitioner is having any criminal antecedent and a fact that no money has been transferred to the account of the present petitioner, then this order stands automatically revoked.

The ABLAPL is disposed of accordingly.
