The Petitioner in this writ petition prays for a direction to the Opposite Parties to take necessary action against miscreants, who are causing obstruction in completing the construction work of Wellness Centre at Sankilo under Katarpada Grama Panchayat, Nischintakoili Block in the district of Cuttack with an estimated cost of Rs.24,17,752/- (excluding GST).
It is submitted by Mr. Jena, learned counsel that the Petitioner has completed 50% of the work, but due to disturbances created by the miscreants of the village, he could not complete the construction work. In the meantime, he has almost completed civil works save and except distempering of inside walls and roof and also colouring the outer walls of the building. If the Block Development Officer, Nischintakoili- Opposite Party No.5 cooperates with the Petitioner, he can complete the same within a period of fifteen days hence.
Counter affidavit has been filed by Opposite Party No.5 stating as under:

It is further humbly submitted that basing upon the letter under Annexure-11, a meeting was held and the B.D.O., Nischintakoili directed the Petitioner to start the construction work. Thereafter, the Petitioner started the construction work. The said wellness centre has not been completed till date. Only the Ground floor, 1st floor, Roof casting work, side wall of both inside and outside plastering work of the said day care sub-centre has been completed. Inside tile flooring work of ground floor and first floor, steel railing of stair case, septic tank, soak pit and inside outside priming, distempering and outside weather coating work has not been started yet. One running bill amounting to Rs.9,01,907/- has been paid to the Petitioner on 22.04.2024 and the Petitioner is allowed to complete the work as per the estimate and no penalty will be imposed on the Petitioner for the extension.”
Mr. Mohanty, learned Additional Standing Counsel, therefore, submits that the Petitioner has been allowed extension of time to complete the work and no penalty has been imposed for such extension. But the Petitioner should complete the work within a reasonable period.
In view of the submissions made by learned counsel for the parties, nothing remains to be adjudicated in this writ petition. Hence, this writ petition is disposed of with an observation that the Block Development Officer, Nischintakoili- Opposite Party No. 5 shall cooperate with the Petitioner by selecting the shade of the colours to be put on both inside and outside walls of the building forthwith and the Petitioner shall take care to complete the work within a period of extension as stated in the counter affidavit.
As requested, a copy of this order shall be made over to Mr. Mohanty, learned Additional Standing Counsel for communication and compliance.
Urgent certified copy of this order be granted on proper application.
