Heard Mr. Dayanidhi Mishra, learned counsel appearing for the petitioner and Mr. Rabi Narayan Mishra, learned Addl. Govt. Advocate appearing for the State of Odisha.
The Petitioner has filed this Writ Petition seeking for a direction to the Opposite Parties to accept the GST quoted by the petitioner which is at the rate of 18% on consolidated remuneration and service charges as per
the Government guidelines in reference to Annexures-3 and 6 and to issue work order to the petitioner, who is the successful L-I bidder in the tender call notice dated 29.02.2024 under Annexures-1 and 2 and also to quash the Order No.1019 dated 16.05.2017 under Annexure-
Learned counsel for the petitioner submitted that the petitioner has filed a representation before the Deputy Collector, Bolangir vide Annexure-10 highlighting the grievance, but no action has yet been taken on the same and therefore, a direction may be given to the Collector and District Magistrate, Bolangir, opposite party No.2 to dispose of the same within a stipulated period.
Learned counsel for the State has no objection to such submission.
Considering the submissions made by the learned counsel for the respective parties, without expressing any opinion on the merits of the case, we dispose of the writ petition directing the Opposite Party No.2 to take a decision on the representation filed by the Petitioner vide Annexure-10 and pass appropriate order in accordance with law within a period of three months from the date of production of a certified copy of this order. The order shall be communicated to the Petitioner
by the Opposite Party No.2 within two weeks of taking decision.
Issue urgent certified copy as per Rules.
