1. This matter is taken up through hybrid arrangement.
Heard learned counsel for the parties.
In filing this Writ Petition, the Petitioner being the supplier of the goods in question to the Opposite Parties, has sought for a direction from this Court to the Opposite Parties for making payment of the outstanding dues to the tune of Rs.14,83,581/- along with interest in her favour.
Apart from the above challenge, the Petitioner has also made the following prayer:-
"(iii) May be pleased to appreciate that the amount outstanding towards the GST, CCST and other dues of the Govt. against the supply made along with loan and other dues outstanding to be paid to the petitioner being a lady as had prayed to incur and meet the market liabilities. 2
(iv) May be pleased to look into the reminders sent along with the bank entries and the department stood against the Opp.Parties being the Government agencies entrepreneurs should not have retained the amount and delayed intentionally making payment and reimburse the dues to the petitioner running its business in proprietorship concerned.
(v) May further be pleased to direct that the details of the supply having been furnished in the dues outstanding should be paid the amount as well as the interest and other dues as have been claied in the facts of the case.
(vi) To pass such other order/orders as is deemed fit and proper by the Hon’ble Court on the facts and in the circumstances of the case in favour of the petitioner;"
Learned counsel for the Petitioner submits that the Petitioner being the Proprietress of M/s. Rashikray Industries a manufacturer of barbed wire used for fencing. He further submits that the Petitioner had supplied barbed wire to the Odisha Forest Development Corporation Ltd. Bhubaneswar for an amount of Rs.14,83,589/-.
Learned counsel for the Petitioner further submits that the Petitioner had made several correspondences and submitted the extracts of ledger account indicating the outstanding dues against the Opposite Parties. However, the concerned authority has not released the outstanding dues in favour of the Petitioner. Hence, the Petitioner is constrained to approach this Court.
In such view of the matter, since the claim made by the Petitioner is disputed by the Opposite Parties, this Court is not 3
inclined to entertain this Writ Petition. However, the Petitioner is at liberty to approach the Civil Court for redressal of her grievance.
The Writ Petition is accordingly disposed of.
