Heard Mr. Rajat Aren and Mr. Raj Kumar Singh, learned counsel appearing on behalf of the petitioner and learned Standing Counsel appearing on behalf of the respondents.
This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner has prayed for the following reliefs:- "(a) issue a writ, order or direction in the nature of Certiorari calling for records of the case and quash the impugned order dated 17.10.2023 (Form GST REG-19) passed by the Respondent No.2 (Annexure No.1 to this petition) cancelling the Registration of the Petitioner without Juri iction and in Violation of Section 29(2)(c) of the U.P. GST Act, 2017. (b) To issue an appropriate Writ, order or direction in the nature of Mandamus commanding the respondent No.2 to Revoke the Cancellation of Petitioner's Registration. ..."

In the present case, the petitioner has indicated that on the date, that is, October 17, 2023 when the order was passed, the returns of only four months were pending, and accordingly, there has been no violation of Section 29(2)(c) of the Uttar Pradesh Goods and Services Tax Act, 2017. 5. In light of the above, the impugned order dated October 17, 2023 is quashed and set-aside. The petitioner is directed to ensure filing of pending returns immediately.
