The present application has been filed under Section 483 BNSS seeking regular bail in connection with FIR No.499/2025 registered at Police Station Shahbad Dairy for the offences punishable under Sections 318(4)/336(3)/340(2)/61(2)/3(5) of the BNS, 2023. 2. Learned counsel appearing for the applicant submits that he is innocent and has been falsely implicated in the present case. According to him, the FIR was registered owing to the commission of offence by Mr. Agnivesh who had allegedly produced the fake documents for obtaining a loan from the Central Bank. So far as the allegations against the applicant are concerned, they are vague. Possession of multiple identity cards at best is an event to implicate him under Section 471 of BNSS, which is triable by the Magistrate. This is a digitally signed order. The submissions are opposed by the Ms. Shubhi Gupta, learned APP appearing for the State. She submits that the applicant is one of the main culprits and the allegations are serious in nature. The learned Trial Court has considered in greater detail and thus found that the applicant is not entitled for grant of bail.
According to Ms. Gupta, the present applicant is responsible for multiple bank frauds to the tune of Rs.1 crore. It is thus stated that the applicant has prepared fake identity card of himself, bank accounts and GST account by using the fake ID in the name of other. It is her contention that in view of the seizure of the fake identity cards, the Investigating Officer has sufficient material to establish the complicity of the applicant. She also submits that there are four accused persons who have been taken into custody. They all are lodged in jail.
I have considered the submissions made by learned counsel for the parties and have perused the record.
The nominal roll would indicate that the applicant is in jail for 9 months and 18 days as on 28.04.2026. By now, he has completed one year incarceration. His date of arrest is 11.07.2025. The investigation has already been completed and the charge-sheet has also been filed. All accused persons have been arrested. There are about 21 witnesses and the trial will take substantial time in its completion.
Even otherwise, the prosecution story would indicate that the complaint was lodged by the Branch Manager of the Central Bank primarily against Mr. Agnivesh who allegedly had submitted forged documents in order to avail a vehicle loan for the purchase of a Maruti Baleno Zeta CNG from Pasco Automobiles, Gurgaon. was made where it was found that on the given address, no one in the name of Mr. Agnivesh was residing.
It is during the investigation of the said case and on receipt of the secret information, the other accused persons, namely, Naveen, Ramesh and the present applicant Sanjay were apprehended while travelling in a Brezza Car. They were found in possession of several forged documents, ATM cards, debit cards, credit cards, rubber stamps and original number plates of a Baleno Car which were recovered from their possession and seized by the police. The said accused persons were arrested and the investigation was carried out. It is seen that there is no criminal case pending against the present applicant. The basic complaint itself was with respect to submission of the forged documents by Mr. Agnivesh. The role of the applicant has been thoroughly investigated and the trial will take enough time in its completion. The continuation of the present applicant, bearing in mind the overall facts and circumstances, would not be justified.
Without expressing any opinion on the merits of the case, the Court deems it appropriate to enlarge the applicant on regular bail on the such terms and conditions as may be imposed by the Trial Court.
