Facts

The petitioners, M/s. Rekha Decorticator & Rice Mill and its proprietor, filed a writ petition seeking a mandamus directing the respondents, including the State of Telangana and the Telangana State Civil Supplies Corporation Limited, to consider their representation dated March 11, 2026. This representation was for the allotment of Custom Mill Rice (CMR) Paddy under the guidelines of G.O.Ms.No.17 dated October 4, 2025. The petitioners stated they had successfully completed 100% of their CMR delivery for Kharif 2019-2020 and had no pending dues. They also highlighted that a case registered under Section 6A of the Essential Commodities Act, 1955, which was later quashed by this Court in Crl.P.No.17563 of 2025, had been disposed of. The petitioners sought consideration of their name for CMR paddy allotment.

Held

The Court directed the respondents to consider the petitioners' representation dated March 11, 2026, in accordance with law and issue appropriate proceedings. The office of the Collector was specifically instructed to issue proceedings within a period of three weeks from the date of receipt of a copy of this order. The Court found merit in the petitioners' plea that their representation, made after the quashing of previous proceedings and in light of the relevant Government Order, warranted consideration. The reasoning was based on the assurance given by the respondent authorities that they would examine the representation as per legal provisions. The ratio decidendi is that representations made by entities fulfilling their contractual obligations and having no pending dues, especially after the resolution of prior legal disputes, should be considered by the authorities in a timely and lawful manner. The writ petition was disposed of with these directions.

Key Issues

1. Whether the action of the respondents, particularly Respondent No. 4, in not considering the petitioners' representation dated March 11, 2026, for the allotment of CMR Paddy under G.O.Ms.No.17 dated October 4, 2025, is illegal, arbitrary, unjust, and violative of Articles 14 and 19(1)(g) of the Constitution of India? Petitioner's Arguments: The petitioners argued that their representation should be considered as they had fulfilled their CMR delivery obligations for Kharif 2019-2020 and had no outstanding dues. They further contended that the previous criminal proceedings, which were quashed by this Court, should not be a bar to their current request. They relied on the High Court's order in Crl.P.No.17563 of 2025. Respondents' Arguments: The respondents, through their counsel, stated that they would consider the representation dated March 11, 2026, in accordance with the law and issue appropriate proceedings.
