ORDER
This Criminal Petition is filed seeking relaxation of the conditions imposed on the petitioner by the trial Court vide order dated 04.06.2026 in Crl.M.P. No.367 of 2026, wherein bail was granted subject to the conditions that the petitioner

shall appear before the SHO on every Monday and surrender his passport before the trial Court.
Heard Sri A. Manoj Kumar, learned counsel for the petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.
Learned counsel for the petitioner submitted that the petitioner is a private employee and the sole breadwinner of his family, and due to his present financial constraints, he is facing difficulty in complying with the condition of appearing before the SHO on every Monday. It is further submitted that the petitioner is unable to comply with the condition of depositing his passport, as the same is not traceable. Hence, he prayed for relaxation of the said conditions.
On the other hand, the learned Additional Public Prosecutor opposed the petition contending that there are no infirmities in the impugned order warranting interference by this Court and prayed for dismissal of the petition.
Having regard to the rival submissions and upon perusal of the material available on record, this Court finds no 3
valid grounds to relax the condition requiring the petitioner to appear before the SHO on every Monday, as the same is necessary to ensure his availability during the course of investigation/trial. However, insofar as the condition relating to surrender of passport is concerned, considering the submission that the passport is not traceable, this Court deems it appropriate to modify the said condition to a limited extent. Accordingly, the petitioner shall file an affidavit before the trial Court stating that he shall deposit his passport as and when it is traced. However, it is made clear that the petitioner shall not leave the country without prior permission of the trial Court.
With the above directions, this Criminal Petition is disposed of.
