The petitioner had initially been served with an order of assessment, dated 17.09.2025, for the period April 2018 to March 2023, under the AP G.S.T. Act, 2017. This order was challenged by the petitioner, by way of W.P.No.32747 of 2025, on various grounds, including the ground that the assessment order is a composite order passed for different assessment periods and the same is impermissible. This Court, by a Judgment, dated 26.11.2025, had set aside the said order, dated 17.09.2025, and left it open to the respondents to initiate fresh assessment proceedings for each assessment year separately.
The petitioner has now again approached this Court, by way of the present Writ Petition, contending that despite the orders of this Court, dated 26.11.2025, the respondents had issued five separate summaries of the order in Form GST DRC-07, dated 19.12.2025 and steps were being taken for recovery of the amounts under these summaries of the order.
Smt. Santhi Chandra, learned Standing Counsel appearing for the respondents, on instructions, submits that there was a glitch in the portal on account of which the authorities could not upload the order of this Court and consequently, the summaries of the order, dated 19.12.2025, came to be issued. She submits that the Authorities are taking steps to make necessary corrections, after the technical glitch is corrected by the Maintenance Team.
She would also submit that the petitioner is already informed that no coercive steps would be taken on the basis of the said GST DRC-07 Form.
In view of the aforesaid submissions, this Writ Petition is allowed, setting aside the Form GST DRC-07, dated 19.12.2025, issued for the years 2018-19 to 2022-23. There shall be no order as to costs. As a sequel, pending miscellaneous applications, if any, shall stand closed.
