O R D E R

This Writ Petition is filed seeking the following relief:

“….to issue a Writ or Order or a direction more particularly in a nature of Writ of Mandamus declaring the action of the Respondents not releasing the payment of the final bill amount the action of the respondents in not releasing the final bill amount gross value of Rs. 3,32,047/- to the petitioner along with interest for the works done by the petitioner in pursuance of agreement entered with the 5th respondent vide agreement dated 18.01.2024 for construction of C.C. Drain from Krishna Reddy House to MPP School at Chinna Garigapalli Village, H/o. Gorivimakulapalli Gram Panchayat, Ramakuppam Mandal, Chittoor District as illegal, arbitrary and violation of the principles of natural Justice and unconstitutional and consequently direct the respondents to release the payment of bill amounts with interest @ 24 percent per annum for the delayed amount to the petitioner in respect of execution of the work and pass such other order…”

Heard learned counsel for the petitioner, learned Assistant Government Pleader for Panchayat Raj and Rural Development, for Respondent Nos.1, 3, 4, 5 and 6 and the learned Standing Counsel for Respondent No.7/Gram Panchayat.

The Writ Petition has been filed challenging the action of the respondent authorities in withholding the final bill amount of Rs.3,32,047/- payable for the work of construction of a C.C. Drain from Krishna Reddy House to MPP School at Chinna Garigapalli Village, pursuant to the agreement dated 18.01.2024, and seeking a direction to release of the said amount along with interest. The petitioner averred that pursuant to the estimates prepared by 6th respondent, he entered into an agreement with 5th respondent for execution of the said work at an estimated cost of Rs.4,00,000/-. It was stated that the work was completed within the stipulated period and to the satisfaction of the authorities, who inspected the work and issued Quality Control Certificates on 29.02.2024. Though the final bill was prepared and passed, the amount remained unpaid despite repeated requests.

It is the grievance of the petitioner that he has been pursuing the matter with the respondent authorities for nearly two years for release of the amounts due. According to him, having executed the work satisfactorily and within the prescribed time, the continued non-payment of the bill amount was arbitrary and unjustified. It was further contended that the delay in payment is causing severe financial hardship, necessitating the filing of the present Writ Petition seeking appropriate directions for release of the outstanding amount.

Learned Assistant Government Pleader for Panchayat Raj and Rural Development, on written instructions received from the Executive Engineer, RWS & S Division, Chittoor-4th respondent, submits that the petitioner is entitled to a net amount of Rs.3,24,727/- after statutory deductions such as Income Tax, GST, Labour Cess, etc., aggregating to Rs.35,676/-. It is further submitted that the bill for a gross amount of Rs.3,60,403/- was received by 4th respondent on 14.06.2024 and is presently pending before the Government for release of funds. The written instructions are placed on record.

Having regard to the fact that there is no dispute with regard to the works executed by the petitioner and the amount payable to him, and in view of the submissions of the learned Assistant Government Pleader for Panchayat Raj and Rural Development, the respondent authorities are directed to pay a sum of Rs.3,24,727/- (Rupees Three Lakhs Twenty Four Thousand Seven Hundred and Twenty Seven only) to the petitioner within a period of four (4) weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition, shall stand closed.
