ORDER:-

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following prayer: “…to issue an appropriate Writ, Order or Direction more particularly one in the nature of WRIT OF MANDAMUS or any other appropriate writ or direction declaring the action of the respondents in not releasing the payments of Rs.60,00,000/-, even after finalizing the bills, payable to the petitioner in relation to the works for 1) Amount of Rs. 40,00,000/-, for the work Land Levelling 1st stage in YSR Jagananna Housing Colony in 23rd Ward Ullipalem Block -I layout in Machilipatnam (Urban) (Layout ID 068124LA000790) Part-3, 2) Amount of Rs. 40,00,000/-, for the work Land Levelling 1st stage in YSR Jagananna Housing Colony in 23rd Ward Ullipalem Block-I layout in Machilipatnam (Urban) (Layout ID 068124LA000790) Part-4 under Non-OTS Critical Infrastructure Grant, is as illegal, arbitrary and violative of Art 14 and 21 of Constitution of India and consequently direct the respondent authorities to release Rs. 60,00,000/- plus GST forthwith for the above said works executed by the petitioner and pass…”

The petitioner is a registered Civil Contractor and is carrying on civil works, such as construction of roads and buildings, etc. The respondents entrusted him with the following works: i) Land Levelling 1st stage in YSR Jagananna Housing Colony in 23rd Ward Ullipalem Block-I layout in Machilipatnam (Urban) (Layout ID:068124LA000790) Part-3 and ii) Land

Levelling 1st stage in YSR Jagananna Housing Colony in 23rd Ward Ullipalem Block-I layout in Machilipatnam (Urban) (Layout ID:068124LA000790) Part-4. He completed the said works within the stipulated time. The respondent Nos.6 to 8 measured the works and entered the same into Measurements Books and that the total works was assessed at Rs.60,00,000/-. The grievance of the petitioner is that, notwithstanding the completion of the entire works, the respondents have not released the bill amounts. Aggrieved thereby, the present Writ Petition has been filed by the petitioner herein.

Heard. Perused the record.

Learned Standing Counsel appearing on behalf of respondent No.3, on written instructions, submits that the petitioner executed the entrusted Land Levelling works. He further submits that with regard to Work-1, the total value of work done is Rs.21,11,076/- and after standard deductions of Rs.4,63,922/-, the net amount payable is Rs.16,47,154/-. However, the balance amount to be paid is Rs.21,11,076/-. With regard to Work-2, the total value of work done is Rs.14,17,521/- and after standard deductions of Rs.3,11,508/-, the net amount payable is Rs.11,06,013/-. However, the balance amount to be paid is Rs.14,17,521/-. He further submits that the Managing Director, APSHCL, Vijayawada submitted the proposals to the Special Chief Secretary to Government, Housing Department, for release of the budget on 16.06.2026 and seeks three months’ time to process the bills. The written instructions are placed on record.

Having regard to the fact that there is no dispute with regard to the works executed by the petitioner and in view of the submissions made by the learned Standing Counsel for respondent No.3, the respondent authorities are directed to pay the admitted amount of Rs.35,28,597/- (Rupees Thirty-Five Lakhs Twenty-Eight Thousand Five Hundred and Ninety-Seven only) (Rs.21,11,076/- + Rs.14,17,521/-) to the petitioner, within a period of three (3) months from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
