Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be
pleased to issue a Writ or Order or a direction more particularly one in the
nature of Writ of Mandamus declaring the action of the Respondents not
releasing the payment of the bill amount of Rs 2,36.12,504/- (Including Price
Escalation G0.94 , G0.35 , GST , Seigniorage QC Charges) to the petitioner
along with interest for the works done by the petitioner in pursuance of
agreement entered in to with the respondent vide agreement y25/21-22/DB
dated 02,02.2022 for providing Construction of Centre for Excellence boys at
Marikavalasa in Visakhapatnam Mandal District, questioned, as the same is
illegal, arbitrary and consequently direct the respondents to release the
payment of bill amounts with interest to the petitioner in respect of execution
of above- mentioned work forthwith and such other or further orders as the
Honble Court feels deem fit and the facts and circumstances of the case
pass

Petition under Section 151 CPC praying that in the circumstances stated
in the affidavit filed in support of the petition, the High Court may be pleased
to, direct the amount of Rs 2,36,12,504/-( including Price Escalation GO.94 ,
GO.35 , GST , Seigniorage QC Charges ) to the petitioner along with interest
for the works done by the petitioner in pursuance of agreement entered in to
with the 7TH respondent vide agreement . 25/21-22/DB dated 02.02.2022 for
providing Construction of Centre for Excellence boys at Marikavalasa in
Visakhapatnam Mandal & District payable to the petitioner forthwith, pending
disposal of the Writ Petition or orders as this Hon'ble Court case. in the
accompanying affidavit the petitioner herein prays Respondents to release
the bill and pass such other order may deem fit and property in the
circumstances of the

The Court made the following Order:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Social Welfare appearing for the respondents.
2.Aggrieved by the action of the respondents in not releasing the payment of a sum of Rs.2,36,12,504/- to the petitioner, along with interest, for the works executed by the petitioner in accordance with the agreement entered into with the respondents.
3.It is contended that the petitioner was awarded a construction contract for the construction of a building for the Centre for Excellence boys at Marikavalasa, Visakhapatnam Mandal & District by Respondent No.7 vide Agreement No.25/21-22/DB dated 02.02.2022. The petitioner had accordingly completed the construction contract. The respondents are due a sum of Rs.2,36,12,504/-
4.The Respondent No.8 has filed a counter affidavit stating that, pursuant to G.O.Ms.Nos.94 and 35, and the recorded measurements, a revised working estimate, for approval was submitted to the Superintending Engineer with a revised estimated cost of Rs.6,81,00,000/- as against the original estimated

cost of the building at Rs.4,95,00,000/-. Upon approval of the revised estimate the remaining balance amount shall be released to the petitioner.
5.Having regard to the same, this Court deems it appropriate to dispose of the writ petition with a direction to the respondents to pay the admitted amount of Rs.2,36,12,504/- due to the petitioner, within a period of eight (08) weeks from the date of receipt of a copy of this order.
6.Accordingly, the Writ Petition is disposed of. No order as to costs.
