This matter is taken up through Hybrid Mode.

Heard Mr. S.K. Dwivedy, learned counsel for the Petitioner and Mr. A. Tripathy, learned Addl. Govt. Advocate for the Opp. Parties.

The present Writ Petition inter alia challenging the order of transfer so issued by Opp. Party No.2 vide order dated 05.06.2026 under Annexure-1. Vide the said order, Petitioner has been transferred from CT & GST Circle Cuttack-I, West to the office of CT & GST Circle- Rayagada in place of Opp. Party No.3. 4. Learned counsel appearing for the Petitioner contended that Petitioner is suffering from cardiac problem and he is under treatment in Capital Hospital, Bhubaneswar. It is also contended

that Petitioner has to take care of his old ailing mother. It is also contended that Petitioner has a minor child of six (6) months.

It is accordingly contended that the impugned order needs interference of this Court.

Learned Addl. Govt. Advocate however contended that since seeking cancellation modification of order dated 05.06.2026, Petitioner has not moved any application either before Opp. Party No.2 or before Opp. Party No.1, the Writ is not maintainable.

Having heard learned counsel for the Parties and considering the submission made, it is observed that if any such application is moved within a period of two (2) weeks hence seeking cancellation/modification of the order dated 05.06.2026, Opp. Party No. 1 shall do well to take a lawful decision on the same within a period of two (2) weeks from the date of receipt of such application. The order so passed by Opp. Party No. 1 be communicated to the Petitioner.

Till a decision is taken as directed, status quo as on today with regard to continuance of the Petitioner be maintained.

Accordingly, the Writ Petition stands disposed of.
