Heard Mr. S. Das, learned counsel appearing for the Petitioner, Mr. P.K. Panda, learned Addl. Standing Counsel appearing for the State-Opp. Party and Mr. S. Swain, learned Sr. Counsel appearing for Opp. Party No. 2. 3. The present writ petition has been filed inter alia with the following prayer:- “It is therefore humbly prayed that your Lordships would be graciously pleased to issue Rule Nisi & call upon the Opposite Parties to show cause as to: Why a Writ in the nature of Mandamus or any other appropriate Writ/Writs must not be issued against the Opposite Parties, to rectify their negligent actions & appoint the Petitioner as an Assistant CT & GST Officer, which comes under the Commissioner of Commercial Taxes & is a . Group-B State Cadre Post, Govt of Odisha (in accordance to the advertisement, vide advertisement no.IIE- 119/2022- 6490/OSSC of 02.11.2022); And may pass any other appropriate Writ/Writs and order/orders which this Hon'ble Court may deem fit, just and proper. And for which act of kindness, the petitioner as in duty bound shall ever pray.”
However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No. 2 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three (3) weeks hence.
It is observed that if such representation is filed within the aforesaid time period, Opp. Party No. 2 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation. The order so passed by Opp. Party No. 2 be communicated to the Petitioner.
With the aforesaid observation and direction, the Writ Petition is disposed of.
