Seeking to direct the 1st respondent to cancel the 10th Constituency Sessions Society Election Conducted by the Respondents 2 to 10 dated 31.05.2026 and also declared the same as null and void and to appoint the Special Officer to conduct the Election as per the by-laws of the society in a fair manner based on the written representations of the petitioner dated 05.06.2026 and 11.08.2026, this writ petition is filed.

Considering the limited scope of the relief sought for, notice to the private respondents is dispensed with.

The learned counsel for the petitioner submitted that the petitioner had submitted representations dated 05.06.2026 and 11.08.2026, seeking to declare the election conducted on 31.05.2026 as null and void, on the ground that the 3/6 https://www.mhc.tn.gov.in/judis election conducted by respondents 2 to 10 was vitiated by serious procedural irregularities and violations of the Constitution, Bye-laws and established election procedures of the Church. However, the said representations are kept pending without consideration. Hence, the petitioner is before this Court.

Heard the learned counsel on either side and carefully perused the materials available on record.

It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon the respondent to consider the same on its own merits and pass appropriate orders in one way or other instead of keeping the same pending indefinitely. As such, non- consideration of the representation made by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking the extraordinary powers under Article 226 of the Constitution of India.

Without going into the merits of the case, this Court directs the 1st respondent to consider the petitioner's representations, dated 05.06.2026 and 11.08.2026 and pass appropriate orders within a period of four (4) weeks from the date of receipt of a copy of this order. 4/6 https://www.mhc.tn.gov.in/judis

With the above directions, this Writ Petition stands disposed of. No costs.
