Janak Machines LTD. vs. State Of Punjab And Ors.
Held
The Court held that since the Goods and Services Tax (GST) Act came into force on 01.07.2017, the Punjab Value Added Tax Rules 2005, under which the impugned notification was issued, are no longer prevailing. Furthermore, the Court noted that the refund already granted to the petitioner could not be recovered at this stage. Consequently, the Court found no case made out to examine the validity of the notification at this juncture. The reasoning is based on the supervening legislation (GST) and the practical impossibility of recovering past refunds. The ratio decidendi is that challenges to pre-GST notifications, especially when the underlying law is repealed and past benefits cannot be reversed, may not be entertained by the High Court in its writ jurisdiction.
Facts
The petitioner filed a writ petition challenging a notification dated 28.07.2006, issued under the Punjab Value Added Tax Rules 2005. The petitioner contended that this notification was ultra vires and resulted in double taxation. The respondents are the revenue authorities. The tax period is not explicitly stated, but the challenge is to a pre-GST era notification. The procedural history indicates the writ petition was filed seeking to quash the said notification. The court noted that the Goods and Services Tax (GST) Act came into force on 01.07.2017, and the Punjab Value Added Tax Rules 2005 are no longer prevailing. Furthermore, the refund already granted to the petitioner could not be recovered.
Key Issues
1. Whether the notification dated 28.07.2006, issued under the Punjab Value Added Tax Rules 2005, is ultra vires and amounts to double taxation, as argued by the petitioner. The petitioner's contention is that the notification imposes a tax in a manner that leads to the same transaction being taxed twice. The revenue's arguments are not recorded in the judgment. The court did not frame specific questions of law but addressed the petitioner's primary contention regarding the validity of the notification and the issue of double taxation.

This writ petition has been filed seeking quashing of notification dated 28.07.2006 (Annexure P-2), on the ground that it is ultra vires as it amounts to double taxation.
As on today, GST Act came into force from 01.07.2017 and this notification dated 28.07.2006 (Annexure P-2) has been issued under the Punjab Value Added Tax Rules 2005 (for short-the Act).
Since the refund already granted to the petitioner cannot be recovered now and the Act is no longer prevailing, therefore, no case is made out to examine this notification at this stage.
Accordingly, the writ petition is dismissed.
