Precision Tech Enterprises vs. Union Of INDIA And Ors.
Held
The Court did not decide the substantive issues regarding the carry forward of input tax credit or the validity of the rejection of the GST Tran-I filing. Instead, the petitioner, faced with the rejection of their request for filing GST Tran-I as per Notification No. 48/2018-CT, sought to withdraw the writ petition. The Court, in its oral order, dismissed the petition as withdrawn. The Court granted liberty to the petitioner to take recourse to remedies available to it in accordance with law. Therefore, no specific finding was rendered on the merits of the petitioner's claim for input tax credit carry forward or the legality of the respondent's action.
