Heard Sri. Narayan V. Yaji, learned counsel appearing for the petitioner and learned Additional Government Advocate for the respondents.

Sri. Shivaprabhu S. Hiremath, learned Additional Government Advocate appearing for the respondent-Government raised a preliminary objection relating to maintainability of the petition and submitted WP No. 100786 of 2023

that, the petitioner has to avail remedy provided under the provisions of Central Goods and Services Tax Act, 2017. 4. Taking into consideration the factual aspects on record and by following the law declared by the Hon’ble Apex Court, in the case of State of Punjab vs. M/s. Shiv Enterprises and others in Civil Appeal No.359/2023 disposed of on 16.01.2023, I am of the view that, the interference at this stage with the impugned order is premature and accordingly, the petitioner is relegated to approach the competent authority in accordance with the provisions under the Act. If such an appeal is filed by the petitioner, same be considered by the respondent- authorities in accordance with law. JUDGE
