ORAL ORDER

This petition under Section 483(1)(b) of BNSS, 2023 is filed with a prayer to relax condition no.3 imposed by the Court of Special Court for Economic Offences, Bengaluru vide order dated 13.01.2025 in Crime No.63 of 2024 which arises out of PCR No.16 of 2024 filed by the respondent.

Learned counsel for the petitioner submits the children of the petitioner have secured admission for higher studies in United States of America and Japan. Therefore, the petitioner needs to travel to the said countries along with his children. Under the circumstances, the impugned condition needs to be relaxed. The petitioner was granted statutory bail by the trial Court in Crime No.63 of 2024 vide order dated 13.01.2025, subject to certain conditions. Condition no.3 found in the said order reads as follows :- "

He shall not leave the country without prior permission of this Court".

The said condition only states that, petitioner shall not leave the country without permission of the Court. There is HC-KAR

no absolute restriction on him. Therefore, it is for the petitioner to file necessary application along with supporting documents seeking permission of the Trial Court to travel abroad for the reason aforesaid. In the event, such an application is filed by the petitioner, the Trial Court shall consider the same on its merits. Since, the petitioner has not approached the Trial Court by filing such an application, this petition cannot be entertained.

Accordingly, this criminal petition is dismissed with aforesaid observations. (S VISHWAJITH SHETTY) JUDGE
