JUDGMENT The petitioner has furnished bank guarantee for release of the detained goods. Now, final order has been passed. The petitioner is proposing to file a second appeal before the Appellate Tribunal. The statutory time limit to file a second appeal before the Appellate Tribunal expires only on 01.10.2018. 2. In such circumstances, till orders are passed on the second appeal or on 10.10.2018, which ever is earlier, the bank guarantee shall not be invoked. It is also made clear that this Court has not made any observation on merits. It is for the respondent to consider the matter in accordance with law. The writ petition is disposed of accordingly.
